四川省消费者权益保护条例(摘要四)

<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">旅游景区、景点的经营者,对有可能危及消费者人身、财产安全的项目、地点,应当采取必要的保护措施。不能设立保障设施的,应当设立醒目警示标志。<span lang="EN-US"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">第二十六条<span lang="EN-US"><span style="mso-spacerun: yes">&nbsp;&nbsp; </span>从事摄影、冲印服务的经营者,交付拍摄、冲印成品时,应当交付全部成品和资料,未经约定不得另收费用;不符合质量要求的,应当根据消费者的要求退还费用,或者免费重新拍摄、冲印。造成交付物品损坏或者丢失的,应当退还全部费用,并按交付物品同种型号价格的十倍给予赔偿,有特别约定保价的,按特别约定赔偿。<o:p></o:p></span></span></p>

<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">第三十二条<span lang="EN-US"><span style="mso-spacerun: yes">&nbsp;&nbsp; </span>供水、供电、供气、排污、有线电视、邮政、通讯、公用网络、公交客运、高速公路、殡葬等公用企业或者依法具有独占地位的经营者,所提供的社会产品或者服务应当符合国家强制标准或者双方约定。<o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">未事先告知消费者需付费而提供的商品或者服务,由经营者承担因此发生的全部费用,不得以任何名目要求消费者支付,不得中断、终止、减少其应当提供的商品或者服务;违反国家的收费规定或者因计量器具不准而多收的费用,应当在核实之日起三十日内,一次性全部退还消费者;非因消费者原因造成计量增加的,不得要求消费者承担因此产生的费用。<span lang="EN-US"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">经营者经营商品或者提供服务以计量作为结算依据的,应当标明法定计量单位,并自备和使用与其经营或者服务项目相应的、符合国家规定的计量器具,保证商品量的计量准确,结算量应当与实际量基本相符,商品的短缺量应当在国家规定允许的范围内。<span lang="EN-US"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">经营者不得擅自中止其所提供的产品或者服务,需要暂停服务的,应当提前以有效方式告知消费者。&nbsp;&nbsp; </p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">第三十三条<span lang="EN-US"><span style="mso-spacerun: yes">&nbsp;&nbsp; </span>房地产经营者与房屋买受人订立商品房买卖合同,有下列欺诈行为,导致合同无效或者被撤销、解除的,房地产经营者应当退还已收购房款及支付利息,并承担已收购房款一倍的赔偿责任:<o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(一)隐瞒没有取得商品房预售许可证明的事实或者提供虚假商品房预售许可证明;<span lang="EN-US"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(二)隐瞒所售房屋、土地已经抵押的事实;<span lang="EN-US"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(三)商品房买卖合同订立生效后,又将该已销售的商品房出卖的。<span lang="EN-US"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">第三十四条<span lang="EN-US"><span style="mso-spacerun: yes">&nbsp;&nbsp; </span>房地产经营者与房屋买受人订立商品房买卖合同前,以“诚信金”、“排号费”、“预购订金”等形式向买受人收取的费用,收取后买受人改变购买意愿的,经营者应当全额退还。<o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">第三十五条<span lang="EN-US"><span style="mso-spacerun: yes">&nbsp;&nbsp; </span>房地产经营者有下列情形之一的,消费者有权解除商品房买卖合同,房地产经营者应当退还已收购房款及支付利息,并赔偿损失:<o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(一)因房屋主体结构质量不合格到期不能交付使用,或者房屋交付使用后,房屋主体结构质量经检验确属不合格;<span lang="EN-US"> <o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(二)因房屋质量问题严重影响正常居住使用;<span lang="EN-US"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(三)商品房买卖合同约定或者《城市房地产开发经营管理条例》第三十三条规定的办理土地使用权变更和房屋所有权登记的期限届满后超过一年,由于房地产经营者的原因,导致消费者无法办理土地使用权变更和房屋所有权登记的。<span lang="EN-US"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">消费者选择解除合同退房时,现时房价高于合同房价的,按现时房价计算;现时房价低于合同房价的,按合同房价计算。<span lang="EN-US"><o:p></o:p></span></span></p></span>
