<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">第六十五条<span lang="EN-US"><span style="mso-spacerun: yes">&nbsp;&nbsp; </span>经营者提供商品或者服务有欺诈行为的,应当按照消费者的要求增加赔偿。增加赔偿的金额为消费者购买商品的价款或者接受服务费用的一倍,经营者承诺增加赔偿的金额高于一倍的,从其承诺。<o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">第六十六条<span lang="EN-US"><span style="mso-spacerun: yes">&nbsp;&nbsp; </span>行政管理部门及其相关单位违反法律、法规规定,强制消费者购买商品或者接受服务,或者指定购买商品或者接受服务的,消费者有权拒绝并拒绝交付费用。因强制消费者购买商品或者接受服务,造成消费者人身、财产损害的,该行政管理部门及其相关单位与商品、服务的提供者应当依法承担赔偿责任。<o:p></o:p></span></span></p>

<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(二)销售质量不合格的商品、提供不符合规范的服务,或者销售以次充好、以假充真的商品拒绝退货、更换、重新按规范提供服务的;<span lang="EN-US"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(三)销售、提供假冒他人商标或者仿冒知名商品特有的名称、包装、装潢的商品,拒绝退货、更换的;<span lang="EN-US"><o:p></o:p></span></span></p>

<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(五)销售国家明令淘汰的商品或者失效、变质、超过保质期、保存期的商品而拒绝退货、更换的;<span lang="EN-US"><o:p></o:p></span></span></p>

<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(八)销售商品或者提供服务时违反国家法律、法规规定滥收费用而拒绝退款的;<span lang="EN-US"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(九)经营者向消费者提供的服务不符合国家法律、法规的规定或者双方约定的标准而拒绝重作、退款或者赔偿损失的;<span lang="EN-US"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(十)经营者拒绝消费者因修理、重作、更换、退货、补足数量、退还货款或者服务费用而必须支付的合理费用的;<span lang="EN-US"><o:p></o:p></span></span></p>
<p class="MsoNormal" style="MARGIN: 0cm="0cm"0cm="0cm"0pt; LAYOUT-GRID-MODE: char; TEXT-INDENT: 24pt; LINE-HEIGHT: 200%; TEXT-ALIGN: left; mso-char-indent-count: 2.0; mso-pagination: widow-orphan" align="left"><span style="FONT-SIZE: 12pt; COLOR: black; LINE-HEIGHT: 200%; FONT-FAMILY: 宋体; mso-bidi-font-weight: bold; mso-font-kerning: 0pt; mso-bidi-font-family: 宋体">(十一)行政机关因消费争议向经营者送达要求其到场协商的文书,五个工作日内无正当理由拒不到场的。<span lang="EN-US"><o:p></o:p></span></span></p>
