南非宪法法院关于诉警备部部长、安全部部长及其他部部长二案之判决

（以下为宪法法院为方便媒体之报道而作之总结，其对宪法法院及其任何成员均无约束力）
此二案乃请求判决《淫秽图像物品法》之第2条第1款是违宪之案件，该条规定禁止拥有带有淫秽图像之物品。本院一致认同Mokgoro法官所签署之命令，主张该条自判决之日起立即失效。然而，各法官所主张其违宪之理由不尽相同。
在由Didcott法官撰写、并获本院多数法官之赞同之判决书中，本院指出，该条规定违反了《临时宪法》第13条保障个人隐私权之规定。本院认为由于该法对带有淫秽图片之物品之规定过于宽泛，因此，其对于隐私权的侵害也更为严重。本院认为，根据宪法第33条第1款之规定，对于隐私权的此种侵害既非合理又不正当，因此，《淫秽图像物品法》第2条第1款之规定是违宪的。
本院认为，对于隐私权之限制仅得依限制条款为之，即仅在当在军营中拥有该物品是非常有害之时，得为特定之目的禁止拥有之，以杜绝此类物品之生产。然而，就系争之规定而言，由于其将一些无害之物品纳入其中，故而乃侵犯了宪法上应当予以保障之隐私权。
本院认为既然已经证明该规定既非合理又不正当地侵犯了隐私权，即无需再对其是否侵害所有者之表达自由予以考量，故对此问题不予审查。
本院之多数意见由Didcott法官代表本院阐述之。Mokgoro法官则发表了不同意见，认为该规定不仅侵害了隐私权，也侵害了表达自由。Langa法官和Madala法官分别发表了赞同Didcott法官之意见，与此同时Sachs法官则独自发表了既赞同Mokgora法官又赞同Didcott法官的意见。
